Terms & Conditions for Employers Posting Job Vacancies on FM-Directive.co.uk

By accessing or using the services provided on FM-Directive.co.uk, you (“Employer”) agree to comply with and be bound by the following terms and conditions. FM Directive Ltd (“we,” “us,” “our”) reserves the right to modify these terms at any time. Continued use of the website following any amendments constitutes acceptance of the revised terms.
1. Services Provided
1.1 FM Directive Ltd provides a platform for employers to post job vacancies and connect with potential candidates within the facilities management industry.
1.2 Employers are solely responsible for the accuracy and legality of the job postings and any interactions with candidates arising from those postings.
2. Registration and Account Use
2.1 Employers must create an account to post job vacancies. Employers agree to provide accurate, complete, and up-to-date information during the registration process.
2.2 Employers are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.
2.3 FM Directive Ltd reserves the right to suspend or terminate accounts that violate these terms or are deemed to pose a risk to the platform.
3. Job Postings
3.1 Employers must ensure all job postings:
- Are accurate, truthful, and comply with applicable laws and regulations.
- Do not contain misleading information, discriminatory language, or offensive content.
- Clearly outline job roles, qualifications, salary ranges (where applicable), and expectations.
3.2 FM Directive Ltd reserves the right to review, modify, or remove job postings that violate these terms or contain content deemed inappropriate or harmful to candidates or third parties.
4. Employer Responsibilities
4.1 Employers agree not to use the platform for purposes other than lawful recruitment, including but not limited to:
- Soliciting business unrelated to recruitment.
- Collecting candidate data for purposes outside the scope of the job posting.
4.2 Employers are responsible for ensuring that their recruitment practices, including offers of employment, comply with all applicable laws, including but not limited to labor, anti-discrimination, and data protection laws.
4.3 Employers agree to treat all candidates fairly, respectfully, and without discrimination based on race, gender, religion, age, disability, or other protected characteristics.
4.4 Clients agree that all applications resulting from job advertisements posted on FM Directive’s platform will be processed exclusively through FM Directive. Sharing contact details or accepting direct applications is a breach of these terms and may result in additional fees or termination of the agreement
5. Payments and Fees
5.1 Posting job vacancies may be subject to fees as outlined on the website. Employers agree to pay all applicable charges and fees £130 for seven days or £330 for thirty days, for job postings (up to 5 listings) in accordance with the payment terms.
5.2 Payments must be made in full before a job posting is published on the website unless otherwise agreed upon in writing.
5.3 All fees are non-refundable unless a posting is removed by FM Directive Ltd due to an error on our part.
6. Intellectual Property
6.1 Employers retain ownership of the content submitted for job postings. By submitting content, Employers grant FM Directive Ltd a non-exclusive, royalty-free, worldwide license to use, modify, and display the content for the purposes of providing the service.
6.2 Employers must ensure they have the right to use and publish all content included in their job postings, including logos, trademarks, and job descriptions.
7. Data Protection and Privacy
7.1 FM Directive Ltd processes personal data in accordance with our Privacy Policy. By using the platform, Employers agree to comply with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018.
7.2 Employers must not collect, store, or process candidate data obtained through the platform for purposes outside the recruitment process without explicit candidate consent.
8. Liability and Indemnity
8.1 FM Directive Ltd provides a platform for connecting employers and candidates but does not guarantee the suitability, availability, or qualifications of any candidate. Employers are responsible for conducting their own assessments and due diligence.
8.2 To the fullest extent permitted by law, FM Directive Ltd shall not be liable for:
- Any losses, damages, or costs incurred by Employers as a result of using the platform.
- Any disputes arising between Employers and candidates.
8.3 Employers agree to indemnify and hold FM Directive Ltd harmless from any claims, liabilities, damages, losses, or expenses arising out of or related to their use of the platform, including but not limited to violations of these terms, employment practices, or infringement of third-party rights.
9. Termination
9.1 FM Directive Ltd reserves the right to suspend or terminate the account of any Employer that breaches these terms or engages in conduct detrimental to the platform or its users.
9.2 Employers may terminate their account by providing written notice to FM Directive Ltd. Any outstanding fees must be settled prior to termination.
10. Governing Law and Dispute Resolution
10.1 These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales.
10.2 Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Miscellaneous
11.1 If any provision of these terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11.2 These terms constitute the entire agreement between FM Directive Ltd and the Employer regarding the use of the platform.
